This website (www.alphaiberian.es) is operated by Alpha Iberian Soluciones Médicas, S.L. (“Alpha Iberian”, “we”, “us” or “our”). By accessing or using this website, requesting our services, or placing an order, you (“you”, “the user” or “the customer”) accept these Terms & Conditions (“Terms”) in full, together with our Privacy Policy and any other policy referenced herein. If you do not agree with these Terms, please do not use the website or our services.
We reserve the right to update, change or replace any part of these Terms at any time by posting the updated version on this page. It is your responsibility to review this page periodically. Continued use of the website or our services after any change constitutes acceptance of those changes.
1. Eligibility and professional use
By using this website you confirm that you are a qualified healthcare professional, or a duly authorised representative of a clinic, wholesaler or pharmacy, of legal age, and that you are entitled under the laws of your jurisdiction to acquire, store, handle and use medical devices and health products. We may require proof of professional status at any time and may suspend or refuse access where such status cannot be verified.
You may not use the website or the products for any unlawful or unauthorised purpose, nor breach any applicable laws (including, without limitation, regulatory and intellectual-property laws), nor transmit any harmful code.
2. Products — regulatory nature
The products we distribute are medical devices and/or health products subject to Regulation (EU) 2017/745 (MDR) and to the applicable national regulations. They must be stored, handled, prescribed and used solely by qualified professionals, strictly in accordance with the manufacturer’s instructions for use and all applicable laws. You are solely responsible for the appropriate, lawful and safe use of the products and for compliance with all regulatory, licensing, customs and professional requirements in the country of destination.
3. Logistics, storage and distribution services
Alpha Iberian provides warehousing, stock control, logistics, distribution and related operational services for the aesthetic-medicine sector. The specific scope, pricing and conditions of any bespoke logistics or distribution service are set out in the corresponding individual agreement, proposal or quotation; these Terms apply in addition to, and not instead of, any such agreement.
4. Orders and formation of contract
An order placed through the website or via our order forms constitutes an offer by you to purchase. A binding contract is formed only when we expressly confirm acceptance of the order or dispatch the products. We reserve the right to refuse or cancel any order at our discretion, including (without limitation) where: the buyer cannot be confirmed as a professional; there are regulatory or jurisdictional restrictions; there is an error in price, description or availability; or we suspect unlawful or improper use.
5. Prices and taxes
Prices are subject to change without prior notice and apply at the time the order is confirmed. Unless stated otherwise, prices are net and exclude VAT and any other applicable taxes or duties, which are calculated in accordance with the applicable law and the destination. Export deliveries may qualify for VAT exemption under Article 21 of Spanish VAT Law 37/1992, where the relevant conditions are met and the corresponding documentation is provided.
6. Payment and retention of title
The accepted payment methods and terms are those indicated at the time of the order. The products remain the property of Alpha Iberian until full payment of the corresponding price has been received (retention of title).
7. Shipping and delivery
We ship across Spain, the European Union and worldwide through vetted carriers. Delivery times are estimates only and are not guaranteed. For business-to-business transactions, the risk in the products passes to the customer in accordance with the agreed Incoterms or, in the absence of agreement, upon handover of the products to the carrier. 8. Returns and cancellations
As our customers are professionals and not consumers, the statutory consumer right of withdrawal does not apply. For health-and-safety and regulatory reasons, returns of medical devices and health products are restricted and are governed by our Return Policy. Any return must be agreed in advance and the products must be unopened, intact and within their validity period, with the cold chain (where applicable) demonstrably maintained.
9. Accuracy of information
We are not responsible if information made available on this website is inaccurate, incomplete or out of date. The material is provided for general information only and should not be the sole basis for decisions without consulting primary or more complete sources. Product information originates from the respective manufacturers. We reserve the right to modify the content of the website at any time, but are under no obligation to update it.
10. Intellectual property
All content and works created by Alpha Iberian on this website (including texts, graphics, logos and layout) are protected by copyright and other intellectual-property rights. Reproduction, editing, distribution or any use beyond the limits of the law requires our prior written consent. Downloads and copies are permitted for private, non-commercial use only.
11. Third-party links and tools
The website may contain links to, or tools provided by, third parties that we neither control nor monitor. Such links and tools are provided “as is” and “as available”, without warranty or liability on our part. The respective provider is solely responsible for their content and conditions; please review them before use.
12. Limitation of liability
To the fullest extent permitted by applicable law, Alpha Iberian shall not be liable for any indirect, incidental or consequential damages, loss of profit, or loss arising from the use or misuse of the products by the customer or third parties. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
13. Data protection
Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Spanish data-protection law, as described in our Privacy Policy.
14. Governing law and jurisdiction
These Terms are governed by Spanish law. Any dispute arising out of or in connection with them shall be submitted to the Courts and Tribunals of the city of Madrid (Spain), without prejudice to any mandatory rules that may apply.
